2. 課程修畢及考試合格者，可獲頒發“大金達人認證咭＂一張。

3. 申請人在任何情況均不得將本課程服務的權利轉讓給第三者。

4. 申請大金達人課程應由上課者/上課者公司依照規定的手續進行。

5. 經本公司許可申請上課之後，本公司將向該申請公司發出達人培訓課程上課通知, 但凡符合以下各項中任何一項時，本公司將不予許可申請上課:

5.1. 申請人申報了虛假的事實時
5.2. 申請人過去曾違反本規章時
5.3. 其他本公司認為申請人不適當時

6. 申請人如地址、電子郵件等其他申報的內容發生變更時，應盡快通知本公司。

保養服務合約條款

1. To participate for any maintenance contract plan, site visit is required for quotation.

2. Service Hours
(a)FREE routine inspection service, repair and maintenance shall be carried out during normal office hours as specified below:-

(b) For any provision of services of maintenance, inspection and warranty service required during non-office hours,service will only be provided during the following hours subject to payment of additional charges per attendance:-

(c) No service will be provided for time other than specified in Clause 1(b) above.

(d) Daikin shall be entitled to charge additional man-hour cost for any servicing, shutdown, repair or replacement works that are specially requested and are carried out after the specified normal office hours defined above.

(e) Routine basic inspection included in the maintenance contract must be finished during the maintenance period, otherwise, the routine basic inspection service will be forfeited. No refund of any payment and no compensation of remaining routine basic inspection service will be made to the Customer for any reasons.

(f) When Typhoon Signal No.8 or above, or Black Rainstorm Signal is hoisted during the service date and time, the inspections, repairs and routine basic inspection service will be cancelled without prior notice. Daikin will re-open after two hours or first working day after the typhoon signal No. 8 or Black Rainstorm Warning is cancelled and contact the affected customer for rescheduling the service date.

3. Booking
For any servicing and/or maintenance requested, Customer shall make an advance booking of at least two (2) working days with Daikin, except in case of emergency (as determined by Daikin).

4. No Refund
No refund of any payment will be made notwithstanding any disposal/transfer of any of the equipment as listed in Section B, or termination of this Maintenance Contract by the Customer for whatever reason.

5. Access & Assistance
Customer shall be responsible for the protection of walls, floors, carpets, furniture, lighting devices and all things and objects within the area of the working location. Customer shall do all that is necessary so that Daikin will have access to the Service Address and/or such reasonable assistance and ancillary tools and appliances such as ladders, working platforms and bamboo scaffold, etc. for accessing to the working place shall be provided. Also, customer shall be responsible for dismantling, reinstatement and making good of false ceiling and decorations, access door openings, wall and slab openings, floor holes, opening access holes and all building works and/or find other parties to relocate the equipment units to allow Daikin’s technicians to access to the air-conditioner as it may require for the purpose of carrying out any servicing, inspection and/or maintenance required under this Maintenance Contract.

6. In case there is any conflict between the terms of this agreement and the terms and conditions, the terms of this agreement shall prevail.

7. Exclusion
(a) This Maintenance Contract shall not cover defects caused by or arising from defective system design or installation fault.

(b) This Maintenance Contract shall not include the following items or services:
1. Replenish refrigerants;

2. Overhauling of air conditioning system;

3. Fixing of refrigerant leakages for air conditioning system;

4. Cost of dismantling, reinstatement and making good of false ceiling and decorations, access door openings, wall and slab openings, floor holes, opening access holes and all building works and/or find other parties to relocate the equipment units for servicing and repair of air conditioning system;

5. Labour cost for replacement of ANY parts after normal office hours;

6. Supply of ancillary tools and appliances such as ladders, and install bamboo scaffold or working platforms for indoor or outdoor part(s)/unit replacement;

7. Replacement of accessories, replenishment of refrigerant, repair service due to the refrigerant leakage from refrigeration system, dismantling and transportation of the air-conditioner units to and from Daikin’s workshop and transportation fee derived from the replacement of part(s). Moreover, improvement works such as relocation of air-conditioner unit(s) or drainpipe etc. will be charged additionally by way of agreed quotations submitted by Daikin.

8. Damages caused by accident, fire, water, vibration, breakage, misuse, negligence, atmospheric climatic or environmental conditions, Act of God, other natural calamities, riot or other civil disturbance, or criminal damage.

Any request for the excluded items will be quoted to you separately.

8. Daikin Airconditioning (Hong Kong) Ltd. reserves the rights on the final decision on the above terms and conditions.

DHK will always keep Customer’s personal data confidential. It is DHK’s policy to respect privacy and the law, in particular the Personal Data (Privacy) Ordinance (‘PDPO’). DHK’s regulations regarding the collection, use, storage, disclosure, transfer, security and inspection of personal data therefore seek to comply with the PDPO, and are set out below:

1. Collection and Use of Data

1.1. Customer will from time to time be required to provide personal information (‘Data’) for access to and use of the Site, and placing of order for Product(s); and such Data will be collected by DHK.
1.2. Customer agrees that Data provided may be stored and used by DHK for the following purposes and any other purpose that Customer may agree with DHK or that is required by law from time to time:

1.2.1. performance or enforcement of the Contract for the sale and purchase of Products ordered; or any reasonable or foreseeable matters in relation thereto;
1.2.2. provision of warranty and/or repair services for Products;
1.2.3. analysis, verification and/or checking of Customer’s credit, payment and/or status in relation to Products ordered or services provided;
1.2.4. processing of payment instruction by Customer;
1.2.5. analysis of orders placed and compilation of statistics for the purpose of improving Products and DHK’s service to Customers;
1.2.6. communication with Customer relating to orders placed or delivery of Products;
1.2.7. providing information relating to Products purchased; and promotional or marketing information to Customer from time to time; and/or
1.2.8. any other lawful purpose related to any of the above.

2. Storage of Data

2.1. Data collected will only be stored for a period reasonably necessary for carrying out any of the above purposes.
2.2. Data will be stored by DHK in a secure manner, with safeguards and measures preventing unauthorized access and requiring authentication and proper authorization for access and disclosure.

3. Disclosure and Transfer

3.1. DHK will strive its best to keep all Data stored by it strictly confidential; and will maintain a high level of control and security over all Data.
3.2. In this regard, DHK confirms that it will not disclose and transfer any Data to third parties except the following:

3.2.1. DHK employees authorized to handle Customer’s Data;
3.2.2. persons with whom Customer transacts any business via the Site, such as any banking, financial or other institutions;
3.2.3. credit agency or debt collection agency for the purpose of credit reporting and verification, and risk management;
3.2.4. any person to whom disclosure is required or compelled by applicable laws, governmental or regulatory requirements; and
3.2.5. any DHK affiliated companies, including DHK’s holding and subsidiary companies, whether existing in or outside of Hong Kong.

3.3. DHK will not disclose and transfer any Data to any third party, except as provided above, without Customer’s consent. However, in no circumstances will DHK be liable for any breach of security or unauthorized use or disclosure of any Data.
3.4. DHK also will in no circumstances bear any responsibility for Data that Customer provides directly to third parties. This policy does not cover or protect any such Data directly provided by Customer to third parties.

4. Opt Out
DHK will provide Customers with an opt-out procedure to reject unsolicited communication or information from DHK. If Customer chooses to opt-out, DHK will nevertheless retain Customer’s contact information, but only for the purpose of customer service, such as warranty and repair services.

5. Access to and Inspection of Data

5.1. Customers will have the right, in accordance with the PDPO, to:

5.1.1. ascertain whether DHK holds any Data of Customer, and the types of Data held;
5.1.2. have access to any Data held by DHK of such Customer;
5.1.3. request correction of any Data held of such Customer;
5.1.4. ascertain DHK’s policies and practices relating to Data; and
5.1.5. not allow DHK to access and use any Data of such Customer.

5.2. For any request relating to the above, Customer may contact DHK at 2570-2786 and 17th – 18th Floors, Futura Plaza, No.111 – 113 How Ming Street, Kwun Tong, Kowloon, Hong Kong.
5.3. Customer acknowledges that DHK has the right to charge a reasonable administrative fee for attending to and complying with Customer’s request on each occasion.

6. Revision to Privacy Policy
DHK is fully committed to complying with the PDPO and all applicable laws relating to the protection of personal data. Hence, DHK will revise and update this Policy from time to time whenever there are changes to the law, or new business models or market practices that necessitate a policy change. Customers will be promptly notified of any revision to this Policy on the Site.
